have a new idustrial building 5 years old and during the winter i have to pump the septic twice a month and not at all during the warmer months. i would presume its because the ground is frozen, how would i corect the problem

I'd inspect the effluent piping between tank and drainfields to see I'd it's above the frost line and freezing. Also check in the D-box for uneven flow among soakbed liines.

You are referring to a section of the Texas Health Code that pertains to onsite septic systems,

TITLE 5. SANITATION AND ENVIRONMENTAL QUALITY
SUBTITLE B. SOLID WASTE, TOXIC CHEMICALS, SEWAGE, LITTER, AND WATER

The Texas code to which you refer, Section 366.017 spells out what a property owner may be required to do if her septic system is found to be in failure or un-sanitary (thus presenting a public health hazard)

Here is the excerpt

Sec. 366.017. REQUIRED REPAIRS; PENALTY. (a) The commission or authorized agent may require a property owner to repair a malfunctioning on-site sewage disposal system on the owner's property:

(1) not later than the 30th day after the date on which the owner is notified by the commission or authorized agent of the malfunctioning system if the owner has not been notified of the malfunctioning system during the preceding 12 months;

(2) not later than the 20th day after the date on which the owner is notified by the commission or authorized agent of the malfunctioning system if the owner has been notified of the malfunctioning system once during the preceding 12 months; or

(3) not later than the 10th day after the date on which the owner is notified by the commission or authorized agent of the malfunctioning system if the owner has been notified of the malfunctioning system at least twice during the preceding 12 months.

(b) The property owner must take adequate measures as soon as practicable to abate an immediate health hazard.

(c) The property owner may be assessed an administrative or a civil penalty under Chapter 7, Water Code, for each day that the on-site sewage disposal system remains unrepaired.

when a building is torn down to the ground nothing left .is it then considered a new construction, then the sepitic
system must be on your on your own land and can not be grand fathered in.(I bought 16" of land on my south side of my land from the estate on my next door property at that time I did not know where there septic system was till they torn the old house down that part of the septic was on my land with no set back .is this up to code in nys

You ask a legal question that you want to address with your attorney.

But in general, it's a real source of trouble to depend on a "grandfathered" septic system serving your home but not on your property.

- you can find that a serious impediment to future sale of the property
- you can find that you can't get a mortgage without a functional septic on your own property
- you can face extra costs and dispute troubles with your neighbor on whose land the septic system resides
